The Council of Ministers plans to adopt in the first quarter of this year a draft amendment to the Aviation Law and some other acts on civilian users of unmanned aircraft (BSP), according to information in the list of legislative and program works of the Council of Ministers.
From 31 December 2020, the national rules and procedures of EU Member States for civilian users of unmanned aerial vehicles (SMEs) have been replaced by EU rules, taking into account transitional provisions (Article. 22 of the implementing regulation). Therefore, it was necessary to adapt the Act of 3 July 2002. – Aviation law, explained.
“In particular, the project is envisaged:
1) an indication of the bodies empowered to carry out the tasks and competences of the Member State and the competent authority set out in the delegated Regulation and the implementing Regulation;
2) defining the rules for the execution of operations using BSP systems;
3) regulating the possibility for the Polish Air Navigation Services Agency to designate geographical zones for BSP systems, extend the existence of geographical zones for BSP systems and the re-determination of geographical zones for BSP, as well as procedures for dealing with applications submitted in this case;
4) normalization of the register of BSP system operators;
5) defining the rules for conducting training and examinations of BSP pilots;
6) an indication of the evidence of formal qualifications of the BSP pilot and entitling to carry out BSP operations, as well as the definition of the procedure for obtaining, extending, suspending and withdrawing them;
7) to regulate the rules for preventing the unlawful execution of operations using the BSP system, including criminal law and on fine penalties;
8) an indication of the rates of fees for the activities provided for in the proposed regulation;
9) establishing sanctions for non-compliance with the provisions contained in the proposed regulation” – we read in the information.
The body responsible for submitting the draft to the Council of Ministers is the Ministry of Infrastructure.
