New Polish restrictions for COVID is expected to apply until January 31, 2022

Most of the restrictions introduced by the amendment to the regulation on the establishment of certain restrictions, orders and bans in connection with the outbreak of the epidemic, are to apply until January 31, 2022, according to the list of legislative and program works of the Council of Ministers. As previously announced, the new regulations are to enter into force next Wednesday.

The project assumes, among others reducing the limitation of the number of people (occupancy of the facility from the current 50% to 30%) who are entitled to use certain types of activities, and a ban on the operation of clubs and discos. At the same time, people who cross the border and will not be able to document that they are fully vaccinated will have to have a negative test result, performed no later than 24 hours before crossing the border.

The project assumed, inter alia,

– extension, until January 31, 2022, of the validity of most of the current restrictions, orders and prohibitions set out in the provisions of the amended normative act;

– adding an additional condition for exemption from compulsory quarantine for a person who runs a shared household with an infected person, if he has a negative test result;

– prohibiting the conduct by entrepreneurs and other entities of activities consisting in conducting:
a) discos and nightclubs or activities which consist in providing space for dancing organized indoors or in other closed spaces, with the exception of sports dance clubs,
b) discos (serving mainly drinks);
c) places for dancing or for other forms of entertainment or recreation organized indoors or in other closed spaces, with the exception of sports dance clubs;
d) places for dancing or for other forms of entertainment or recreation organized indoors or in other closed spaces, with the exception of sports dance clubs;

– limitation of the number of people (occupancy of the facility from 50% to 30%) who are entitled to use certain types of activity;

– introducing an obligation to ensure that the viewers or listeners do not eat drinks or meals;

It is also planned to modify the existing regulations regarding the exclusion from the limit of people using services or participating in specific events (per service provider’s space or the number of participants in the event), people vaccinated against COVID-19.

The draft regulation proposes to clarify the applicable regulation in such a way that the regulation clearly states that it is up to the person who intends to use the service or participate in the event to decide whether he or she wants to exercise the right related to vaccination against COVID-19, in the case of reaching a limit resulting in a restriction in access to this service or event; however, it should be emphasized that, as a rule, the essence of the legal norm in this respect will not change – this activity will still be voluntary – the person will still have the right to refuse to present a document or certificate confirming vaccination, with the proviso that in this case it will, however, be subject to the limit specified in the regulation.

The regulation will also include a provision that the vaccine may be administered to people after the age of 5.
