During today’s approval of the draft new building law, deputies adopted a number of amendments, and some of them even despite the dissenting opinion of the Minister for Regional Development Klára Dostálová (for YES). For example, despite her disagreement, an amendment was passed which removes the requirement for direct daylight and direct ventilation from the definition of a living room. Due to this, KSČM deputies refused to support the law. The vice-president of their club, Leo Luzar, described it as scandalous and a return to the Middle Ages.
The proposal was submitted by MEPs Martin Kolovratník, Adam Kalous and the Social Democrat Petr Dolínek, in which they proposed a new formulation of the living room, from which the requirement for direct daylight and direct ventilation fell. The living room would not have to have a window. They state, for example, that the requirement for direct lighting cannot be met in every room. “Insisting on the requirement of exclusive daylighting makes it impossible not only to build new housing in the classic street profiles of the city centers where apartments and housing belong, but also in the gaps where they used to be, and even simple apartment renovations if they require a permit,” they said.
Despite the disapproval of Minister Dostála, the deputies also approved another of Dolínek’s proposals, which is to facilitate the construction of social and hygienic facilities in parks and public greenery. To a certain extent, it should be a small building that would not require a permit. The Minister pointed out that the Ministry of the Interior or Culture did not agree with the proposal either.
Despite the Minister’s disapproval, the Chamber of Deputies also accepted the proposal of a group of SPD deputies that in the event of fines, the authorities should take into account who they are imposing. For natural persons, the authorities should take into account their personal circumstances and for legal persons and entrepreneurs the nature of their activities. For example, it will be a question of whether it is a construction company or a company whose business is remote construction.
However, the Chamber of Deputies accepted the proposal, which was submitted directly by Minister Dostálová with deputies Luzar and Dolínek. It introduces the concept of green infrastructure into the Building Act. It will be a system of green areas, water areas, vegetation elements or greenery inside the blocks. The green infrastructure will be newly addressed by spatial planning documentation.
In accordance with the negative attitude of the Minister for Regional Development, the Chamber of Deputies rejected the proposal of deputies Kolovratník, Kalous and Dolínek, who was to transfer spatial planning to the independent competence of municipalities and regions. Its authors argued by emancipation and strengthening of self-government. However, Minister Dostálová has previously described him as debatable and took a negative position on him. She warned that this was a change in the whole system and pointed out problems with money. “The problem of spatial planning of independent competence is mainly its financing. The Minister expressed her fundamental disagreement with the proposal of deputies Kalous and Kolovratník, who automatically proposed a general building permit. If, for example, a period of 30 days had elapsed in vain for a simple construction, then the permit would be issued on the first day after the expiry of the period. The Economic Committee did not recommend approving this proposal, the Minister of Culture Lubomír Zaorálek (ČSSD) also warned against it. “The aim of the new legal regulation is to speed up the permitting procedure and real protection of the participants in the proceedings against illegal inaction of the authorities,” the deputies justify their proposal. The Chamber of Deputies did not approve it.
