Court annulled part of the zoning plan of Pardubice near the railway station

The court in Pardubice annulled part of the Pardubice zoning plan in the area behind the shopping area near the railway station. This follows from the judgment requested at the Regional Court in Hradec Králové. The investor wants to build more retail space on the site and has already received a zoning decision. Environmental activists who challenged the city’s zoning plan in a lawsuit are satisfied, even though the court has not yet annulled the zoning decision. They consider the area near the important landscape element Horseshoe with the blind arm of the Elbe to be a valuable natural locality. Pardubice is still waiting for the reasoning of the verdict.

“We are convinced that we have evidence that the authorities, which were obliged to protect natural values ​​and act in accordance with the Nature Protection Act when issuing changes to the zoning plan and zoning decision, did not do well,” Miroslav Seiner, chairman of the Civic Association that filed the lawsuit. According to him, the court also issued an interim measure suspending the zoning decision.

Pardubice will comment on the decision of the regional court only when they have a written copy of the judgment, because without the details given in it it is not possible to form an opinion. “In general, it can be said that the court’s decision may affect the activities of the private investor, not the statutory city of Pardubice,” said municipality spokesman Radim Jelínek.

Activists have also repeatedly suggested that a large ash tree about 160 years old growing in the area be declared a memorial tree. In the end, they succeeded for the third time, the developer appealed against the municipality’s decision. Before that, however, the investor cut down all other woody plants, his progress was stopped at the initiative of ecologists by the city, and the regional authority confirmed his step.
