The Fire Protection Act will apparently specify the scope of documents assessed by the Fire and Rescue Service when permitting buildings as part of state fire supervision. This is provided for in the amendment to the Fire Protection Act, which was approved by the Chamber of Deputies in the first reading today in an accelerated mode. The proposal was signed by five coalition MPs and one from the opposition ANO movement. The government has given its consent to the draft. The Senate will now examine the draft.
The drafters state that the Fire Protection Act has undergone a number of changes during the adoption of the new Construction Act and related amendments to the law. This year, however, the House passed an amendment to the Construction Act which delayed the entry into force of some of the changes and altered the regulation of construction administration, along with approving related amendments to other laws. However, according to the drafters, there was a legislative error, because the amending law also abolished the regulation of documentation and other documents assessed in the framework of state fire supervision in procedures under the Construction Act.
The MPs’ proposal does not aim to change or extend the powers of the Fire Rescue Service of the Czech Republic and does not exceed or undermine the area which the legislator intended to entrust to the competence of this body, the explanatory memorandum states. The deputies also assure that the proposal has no impact on the state budget.
The ministries expressed mostly positive opinions in the comment procedure. “The draft now submitted sets out a list of construction documentation subject to the exercise of state fire supervision, in accordance with the new Construction Act. The proposed amendments to the Fire Protection Act do not in any way complicate the position of builders, nor do they pose complications for construction,” the Ministry of the Interior, for example, said.
