Serbina Consulting must pay CZK 800,000 to Heimstaden (formerly Residomo) as damages. The decision was made by the Regional Court in Ostrava, which dealt with the lawsuit filed by Heimstaden, the largest private rental housing provider in the Czech Republic. In it, she sought compensation for the damage caused to her by Serbina by filing an insolvency petition, which the court rejected as unfounded shortly after filing. Kateřina Piechowicz, a spokeswoman for Heimstaden, told to ČTK.
“The court upheld Heimstaden’s arguments that it was an unjustified attempt by Serbina Consulting to harm Heimstaden,” Piechowicz said.
Serbina Consulting, formerly Arca Services, which belonged to the Arca Capital group of Slovak financier Pavol Krupa, filed for insolvency with Heimstaden Czech (then Residomo) in April 2017. The court rejected the petition the same day and imposed a disciplinary fine on Serbina Consulting.
Heimstaden then filed a lawsuit seeking compensation for one million crowns and an apology. The court accepted both of his claims, however, according to him, the provision of an apology is irrelevant after several years. Heimenburg granted compensation in the amount of CZK 800,000, which according to the company is one of the highest compensation awarded in the Czech Republic for such damage.
“We were confident in our victory from the beginning and I am glad that our arguments were fully acknowledged by the court. It is also a message to all these financial raiders to reconsider similar actions against established and well-functioning companies in the future,” commented on the court’s decision. Director of Heimstaden Jan Rafaj.
Heimstaden also started its operations in Poland in 2020 with the acquisition of two construction projects for the rental market in Warsaw. At the beginning of 2021, construction of 640 new apartments will begin in Praga-Północ and Służewiec. The first tenants will be able to accept the facilities in the first quarter of 2022 and 2023, respectively.
