Developer wants hundreds of millions for an allegedly failed investment, Mayor Jenče refuses

The developer VPP Develop Jeneč wants over 590 million crowns for an allegedly failed investment in Jeneč. The mayor of the village, Michal Stark, denies that he prevented the developer from building. According to him, the municipality is preparing a new zoning plan and now there is a construction ban until the new plan is in effect.

According to the developer, the municipality is thwarting the investment with a closure lasting several years, inactivity during the preparation of a new plan and changes to the rules. He therefore filed a lawsuit with the District Court for Prague-West. According to the Building Act, the amendment and preparation of new spatial plans is one of the powers of the municipality.

According to the mayor, there are adjustments in the new spatial plan, but the building areas will remain buildable. “There are detailed regulations,” added the mayor. The spatial plan is a document that is supposed to guide the development of the municipality and the amount of construction. It can limit buildings according to various criteria. You can regulate, for example, the number of floors, the degree of buildability of the plot, and the like.

The development company also criticizes the alleged differences between the original specification of the spatial plan, which did not specify a specific maximum number of apartments for the area, and the subsequent proposal. “On the contrary, the draft zoning plan stipulates the maximum number of apartments in a defined area, which dramatically reduces the usability of the land, and thus also its value,” described the legal representative of the developer, Daniel Hájek, in the lawsuit.

The preparation of new spatial plans also took many years in other central Bohemian cities, for example in Kladno, Nové Strašec, Rakovník and Mělník.

In Jenč, two associations are running in the upcoming municipal elections. One is Pro Jeneč, where mayor Michal Stark is the leader. The second candidate was put together by the KSČM, the leader is Bohuslav Denk.
