KNF pushes bill for manager accused of fraud

6 November 2012

Poland’s anti-monopoly regulator, KNF, is one step closer to tightening penalties on business managers involved in fraud, according the daily Puls Biznesu reports. At the same time, KNF head Małgorzata Krasndębska-Tomkiel has added a clause to the bill, guaranteeing managers the right to defend themselves.
Under this proposal, which must be approved by the government, the KNF must prove the defendant guilty before enforcing the law, meaning the accused manager would not be obligated to prove their innocence. In its current form, the bill would impose a penalty of PLN 0.5m on each manager found guilty. Market watchers, however, are leery of the proposed changes. “This draft includes many disadvantages for entrepreneurs,” said Bartosz Wyżykowski of PKKPM Lewiatan. “This is why we are appealing to the government to reject it.”
