Prague 3 filed an administrative lawsuit against Metrostav’s high-rise building in Vackov

Prague 3 has filed an administrative lawsuit against the issuance of a zoning decision for the construction of a fifteen-storey house in Vacek near the park of the Jewish Furnace. City Hall spokeswoman Zuzana Křížková. The council approved the move last week in response to the city council’s rejection of the district. According to the management of Prague 3, the building will be too tall, it does not fit into the area and the zoning procedure had serious shortcomings. Metrostav Development wants to build the building as another part of an extensive construction in Vackov.

The planned construction is to follow on from several finished apartment buildings in the area bordered by Olga Havlová, Rixdorfská and Na Vackově streets. The appeal of Prague 3 was rejected by the municipal department of territorial development in mid-January. The Ministry of Regional Development has also previously confirmed the department’s original opinion that the plan is in accordance with the city’s spatial planning documentation. However, the City Hall of Prague 3 does not agree with this.

As the city district had exhausted all possibilities of appeal against the decision, only the possibility to file an administrative action remained, the spokeswoman said. The lawsuit was filed by the office on Friday. The city district will be represented in the dispute by the office of Frank Bold Advokáti, who, according to the approved document, will also request the suspensory effect of the lawsuit. This would make it impossible for the investor to continue preparing for the construction, but it will be necessary to prove that the enforcement of the zoning decision would cause greater damage to the city district than could be incurred by other persons by granting a suspensive effect.

In its rejected appeal, the city district argued that the fifteen-storey building would mean a significant impact on the site and shading of the adjacent park. In the opinion of the city district, the documentation submitted by the investor, which does not take into account wider transport links, the proximity of the Kbel airport protection zone or the earlier territorial study of the area, is also insufficient.

The town hall also disagreed with the use of the highest possible coefficient for calculating floor areas. According to Prague 3, the Monuments Department did not justify its consent to the construction, even though the Ministry of Culture commented on the height in connection with the preservation of the Prague skyline.

Metrostav spokesman Vojtěch Kostiha previously stated that the study of the building was presented in September 2018 to the district development committee of the city district, the project received positive opinions from all relevant bodies and the management of Prague 3 originally agreed with it. The change occurred after the elections in October 2018, when the current political representation of the city district took office.
