The Office of Competition and Consumer Protection (UOKiK) imposed a total of over PLN 2.1 million fines on companies producing men’s formal clothing – Kubenz, Recman and Dastan Logistics, the Office said. As shown by the controls of the Trade Inspection and detailed tests at the UOKiK laboratory in Łódź, the information on the labels about the composition of clothes did not correspond to reality.
“The consumer is not able to independently verify the composition of the clothing, so he trusts the information provided on the label. The responsibility for ensuring that it is correct rests only with the producer – labels must not be misleading. Otherwise, the consumer unknowingly buys a product that does not meet his expectations. If consumers knew that there is no wool in a jacket offered as ‘woolen’, they could give up the purchase,” said Tomasz Chróstny, President of UOKiK.
For violating the collective interests of consumers and misleading consumers, the President of UOKiK, Tomasz Chróstny, imposed financial penalties, respectively: Kubenz – PLN 962,068, Recman – PLN 1,105,428, Dastan Logistics – PLN 42,930.
Recman and Kubenz changed the labeling of the clothes produced according to the actual composition, therefore this practice was abandoned by them. This was confirmed by additional laboratory tests carried out in August 2021. Dastan Logistics changed the markings of products only for those whose composition did not agree with the results of laboratory tests, therefore the decision imposed an order on the entrepreneur to discontinue the practice with the pain of immediate feasibility. Kubenz and Recman must notify consumers of the decision – on their websites, on Facebook profiles and at checkouts in company stores, it has been completed.
