The President has signed an amendment to the Energy Law, which aims to implement a number of European laws in the area of energy; introducing provisions to allow, from 2026, a technical change of electricity seller in 24 hours and access for electricity consumers with annual consumption below 100,000 kWh to compare electricity sales offers, according to the President’s Office.
The amendment to the Energy Law:
– introduces provisions to allow a technical change of electricity seller in 24 hours from 2026;
– introduces for household electricity consumers and micro-entrepreneurs with annual consumption below 100,000 kWh to a tool for comparing electricity sales offers;
– introduces a legal framework for the operation of citizen energy communities, regulates their rights and obligations, including the right of a consumer to join a citizen energy community while retaining full consumer rights and to leave the community without penalty;
– introduces the right of a consumer to enter into contracts with dynamic electricity prices with any seller with more than 200,000 customers, and the right to receive information on the benefits and risks of such contracts;
– introduces provisions on the aggregator in the electricity market, its tasks and powers;
– introduces provisions on off-taker and active customer responses in the energy market;
– introduces a new model for the sale of reserve electricity;
– strengthens the existing rights of consumers and introduces new rights with regard to the sale of electricity; and aligns the provisions of the Act with the provisions of the Energy Policy of Poland until 2040, inter alia, with regard to the obligation to conclude only comprehensive agreements (covering both the sale and distribution of energy) with a household electricity consumer;
– adds provisions designed to provide a legal basis for energy companies involved in the transmission or distribution of electricity or gaseous fuels to coordinate actions and exchange information in the case of applications for connection to the gas network and electricity network with a voltage rating of 110 kV and above, of equipment, installations or networks using gaseous fuel for the generation of electricity;
– makes changes to direct line regulation;
– reduces the administrative burden on owners of generation sources with a capacity greater than 2 MW;
The Act will enter into force 14 days after the date of promulgation, except for regulations entering into force at a different date.
