Order no. 719/740/M.57/2333/2014, concerning enforcement rules on sale and purchase of agricultural land outside the city limits was published in the Official Gazette on 30th of May 2014.
According to the Law no. 17/2014, which came into force on April 11, 2014, the following persons have the right to purchase agricultural land outside city limits: Romanian citizens, citizens of EU countries, citizens belonging to the European Economic Area Agreement (EEAA) and Swiss Confederation, stateless persons residing in Romania, a EU member state, a state in EEAA or the Swiss Confederation, Romanian legal entities, legal entities having the nationality of an EU Member State, the States party to the EEAA or the Swiss Confederation.
Individuals mentioned above can purchase agricultural land outside city limits by respecting the right of preemption of the co-owners, leaseholder, neighbors and Romanian state, represented by the State Domains Agency (ADS), in that order. Preemption right is the right to have priority in purchasing an asset.
Enforcement rules determine exactly every step to be followed for the sale of agricultural land located outside the city. If none of the persons mentioned above (peemptors) expresses its intention to purchase within the period provided by law, the sale is free.
“In this situation, the City Hall issues a certificate to the seller, accompanied by a certified copy of the original offer for sale, the seller choosing a buyer. In such situation, if the offer does not provide any specific condition, the land may be sold under any terms, except for decreasing the price”, according to the provisions of Law no.17/2014.
